Waste Disposal Paddington Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Disposal Paddington provides waste collection and related services to domestic and commercial customers. By making a booking, using our services, or allowing us access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste disposal or collection service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, company or organisation that requests, books, or receives waste disposal or collection services from Waste Disposal Paddington.

Services means any waste collection, waste removal, rubbish clearance, recycling, loading, transportation, or related activity carried out by Waste Disposal Paddington.

Waste means any items, materials, refuse, junk, rubbish, debris, or similar material to be collected, removed, transported or otherwise handled by Waste Disposal Paddington as part of the Services, excluding any prohibited or hazardous items defined in these Terms and Conditions.

Agreement means the contract between Waste Disposal Paddington and the Customer for the provision of Services, comprising these Terms and Conditions, together with any written or verbal booking confirmation issued by Waste Disposal Paddington.

2. Scope of Services

Waste Disposal Paddington provides waste disposal and collection services, including household waste removal, commercial waste clearance, garden waste collection, bulky item removal, and general rubbish collection within our designated service area.

The specific Services to be provided, including the type and estimated volume of Waste, collection address, dates, times, and any special instructions, will be agreed with the Customer at the time of booking. Waste Disposal Paddington reserves the right to refuse any Waste that is not accurately described at the time of booking or that does not comply with applicable waste regulations.

3. Booking Process

3.1 Customers may request a booking by telephone, email, or through any other booking method made available by Waste Disposal Paddington. The Customer is responsible for providing accurate and complete information, including contact details, collection address, access information, description and approximate volume of Waste, and any relevant timing requirements.

3.2 A booking is not confirmed until Waste Disposal Paddington has accepted the request and provided the Customer with a booking confirmation, which may be given orally, in writing, or by electronic communication. Waste Disposal Paddington reserves the right to decline any booking request at its sole discretion.

3.3 Any quotation provided before a site visit is an estimate based on the information supplied by the Customer and is subject to change if the actual type or quantity of Waste differs from that described, or if access conditions and other relevant circumstances vary.

3.4 The Customer must ensure that all necessary permissions, consents, or permits required for access to the collection location are obtained before the booked collection time. This includes any building management approvals, parking permissions, or access codes as applicable.

4. Service Area and Access

4.1 Waste Disposal Paddington delivers Services within its designated operational area, which focuses on Paddington and surrounding districts. Service availability on specific dates and times is subject to scheduling and capacity.

4.2 The Customer must provide safe, reasonable, and lawful access to the collection point. Our team must be able to safely park as close as reasonably practicable to the location of the Waste and must be able to move the Waste from the premises without undue difficulty or risk.

4.3 If access is restricted, unsafe, or significantly more difficult than described at the time of booking, Waste Disposal Paddington may at its discretion: adjust the price to reflect additional time or resources required; limit the scope of the Services; or cancel the collection, in which case a call-out or cancellation fee may apply.

5. Customer Responsibilities

5.1 The Customer is responsible for ensuring that:

The Waste is clearly identified, segregated where appropriate, and ready for collection at the agreed time.

The Waste does not include prohibited items such as hazardous, clinical, or certain controlled wastes as described in these Terms and Conditions.

Any items the Customer does not want removed are clearly separated from Waste to be collected.

All information provided to Waste Disposal Paddington in relation to the Waste and collection conditions is accurate and not misleading.

5.2 The Customer must be present at the premises at the agreed time of collection unless otherwise agreed in advance. If no authorised person is available to grant access or confirm the items to be collected, Waste Disposal Paddington may cancel or reschedule the Service and may charge a wasted journey fee.

5.3 The Customer confirms that they have full authority to dispose of the Waste and that the removal of such Waste will not contravene any third-party rights, tenancy agreements, property rules, or applicable laws.

6. Waste Types and Regulations

6.1 Waste Disposal Paddington operates in accordance with applicable UK waste management and environmental legislation. All Waste collected will be transferred to appropriately licensed facilities where it will be processed, recycled, or disposed of in compliance with legal and regulatory requirements.

6.2 The Customer must not include any of the following in the Waste unless expressly agreed in advance and lawful arrangements are in place for handling such materials: hazardous waste; clinical or medical waste; asbestos or materials containing asbestos; chemicals, solvents, oils, paints, or fuels; gas bottles or pressurised containers; explosives or ammunition; radioactive materials; or any other substance classified as hazardous or requiring special treatment under applicable law.

6.3 If prohibited or hazardous items are discovered among the Waste after collection, Waste Disposal Paddington may:

Refuse to collect or remove such items.

Return the items to the Customer where lawful and practicable.

Charge the Customer for any additional costs, disposal charges, or regulatory fees incurred in safely dealing with such items.

6.4 Waste Disposal Paddington may provide guidance on the appropriate handling and disposal routes for specific waste streams, but it remains the Customer’s responsibility to truthfully declare the nature of all Waste presented for collection.

7. Pricing and Payment Terms

7.1 Prices for our Services may be provided based on: estimated volume of Waste, weight, type of materials, labour time required, and access conditions. Unless otherwise stated, all prices are expressed exclusive of any applicable taxes.

7.2 Where an initial estimate is given by telephone or electronic communication, the final price will be confirmed on site before work begins, after assessment of the actual Waste and collection conditions. If the Customer does not agree to the adjusted price, Waste Disposal Paddington may cancel the collection, and a call-out or attendance fee may be charged.

7.3 Payment is normally due at the time of collection, unless alternative arrangements are agreed in advance. Waste Disposal Paddington accepts commonly used payment methods, which may include cash, card payment, or bank transfer, depending on current business practices.

7.4 For business Customers with approved credit accounts, payment terms will be specified separately. In the absence of a separate written agreement, payment is due within 14 days of invoice date. Waste Disposal Paddington reserves the right to charge interest on overdue sums at the statutory rate, together with any reasonable recovery costs.

8. Cancellations and Rescheduling

8.1 The Customer may cancel or reschedule a booking by contacting Waste Disposal Paddington as soon as reasonably practicable.

8.2 If the Customer cancels more than 24 hours before the scheduled collection time, any pre-paid amounts may be refundable or transferable, subject to any non-recoverable costs already incurred by Waste Disposal Paddington.

8.3 If cancellation occurs less than 24 hours before the scheduled time, or if our team attends the site but cannot complete the collection due to reasons within the Customer’s control, Waste Disposal Paddington may charge a cancellation or wasted journey fee to cover time, travel and administration.

8.4 Waste Disposal Paddington may, on rare occasions, need to cancel or reschedule a booking due to circumstances beyond its reasonable control, such as severe weather, vehicle breakdowns, staff illness, or legal restrictions. In such cases, we will notify the Customer as soon as reasonably possible and offer an alternative time or a refund of any pre-paid charges relating to the affected Service. Waste Disposal Paddington will not be liable for any indirect or consequential losses arising from such cancellations.

9. Performance of Services

9.1 Waste Disposal Paddington will use reasonable care and skill in providing the Services and will make reasonable efforts to arrive within the agreed time window. However, times are estimates, and delays may occur due to traffic, operational issues, or events beyond our control.

9.2 On arrival, our team will confirm the Waste to be collected, assess access and safety conditions, and confirm the final price before commencing work. The Customer or their representative must be available to provide instructions and confirm acceptance of any revised charges.

9.3 If, during performance of the Services, it becomes evident that the Waste is substantially more than estimated, or contains prohibited materials, Waste Disposal Paddington may adjust the price, restrict the amount of Waste taken, or decline to continue the Service. Any partial work completed may be charged proportionately.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10.2 Subject to the above, Waste Disposal Paddington will not be liable for any indirect, consequential, or economic loss, including loss of profit, business interruption, or loss of opportunity, arising out of or in connection with the Services or this Agreement.

10.3 Waste Disposal Paddington will take reasonable care while removing Waste from the Customer’s premises. However, minor scuffs, marks, or superficial damage to walls, floors, or doorways may occur where access is tight or obstructions cannot be reasonably avoided. The Customer is responsible for protecting or removing any vulnerable items or fixtures in advance of the collection.

10.4 If damage is caused to property solely due to the negligence of Waste Disposal Paddington, the Customer must notify us in writing as soon as reasonably practicable, and in any event within 7 days of the incident. Liability for proven damage will be limited to the reasonable cost of repair or replacement of the affected area or item, subject to a maximum aggregate liability equal to the total price paid or payable for the relevant Services.

10.5 The Customer indemnifies Waste Disposal Paddington against any costs, claims, or liabilities arising from: inaccurate or misleading information provided about the Waste or premises; breach of these Terms and Conditions; or disposal of Waste where the Customer did not have proper authority to arrange its removal.

11. Title and Risk in Waste

11.1 Title to Waste passes to Waste Disposal Paddington at the point at which it is loaded onto our vehicle, provided that the Waste is lawful to collect and the Customer has authority to dispose of it. Prior to loading, all Waste remains the sole responsibility and property of the Customer.

11.2 Once loaded, Waste Disposal Paddington assumes responsibility for transporting and disposing of the Waste in accordance with applicable law and good environmental practice. The Customer acknowledges that items removed as Waste will not be recoverable unless specifically agreed in advance.

12. Data Protection and Privacy

12.1 Waste Disposal Paddington may collect and process personal data relating to Customers, including contact details, addresses, and payment information, for the purposes of managing bookings, providing Services, processing payments, and maintaining records.

12.2 Personal data will be handled in accordance with applicable UK data protection legislation. We will take reasonable steps to keep such information secure and will not share it with third parties except where necessary to perform the Services, comply with legal obligations, or where the Customer has given consent.

13. Complaints and Dispute Resolution

13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Disposal Paddington at the earliest opportunity, providing full details of the issue.

13.2 We will investigate complaints in a fair and timely manner and seek to resolve them through discussion with the Customer. Where appropriate, we may offer remedial work, a partial refund, or another form of reasonable redress.

13.3 If a dispute cannot be resolved amicably, either party may pursue their rights through the courts in accordance with the governing law clause below.

14. Variations to Terms

14.1 Waste Disposal Paddington may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the relevant Services unless a later version is expressly agreed with the Customer.

14.2 Any variation to these Terms and Conditions requested by the Customer must be agreed in writing by an authorised representative of Waste Disposal Paddington to be effective.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed severed from the Agreement, and the remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by Waste Disposal Paddington.
